Small Business Tax Tips: Are You Ready For The January 31 Deadline?

April 15 is not the only critical tax deadline. If you are a small business owner with employees or independent contractors, January 31 is an important tax deadline you cannot afford to ignore.


The end of January is the due date for several payroll-related tax forms and tax payments. Before reviewing them, here’s some good news. Whenever a federal tax deadline falls on a Saturday, Sunday or legal holiday, the due date is automatically moved to the next business day.

Since January 31, 2009 is a Saturday, the due date has been extended to Monday, February 2, 2009. (Perhaps those two extra days will come in handy!) Also keep in mind that to comply with any federal tax deadline, your mailing must be postmarked on or before the due date.

 

Here are the key federal payroll forms and tax payments due on February 2, 2009:

1. Form 941, Employer’s Quarterly Federal Tax Return. This is the form used to report all employee compensation (wages, salaries, commissions, bonuses, etc) during the fourth quarter, as well as federal income tax withholdings, social security taxes and medicare taxes (both the employee’s withholding amount and the employer’s match).

If the quarter’s total tax (as shown on Line 10) is more than $2,500, then you should have been making payroll tax payments during the quarter according to the IRS payroll tax payment requirements. (See IRS Publication 15 for details on that.)

But if the quarter’s total tax is less than $2,500, you can pay your entire quarterly payroll tax liability with Form 941. Just be sure to include voucher Form 941-V with the return and make your check payable to the U.S. Treasury.

2. Form 940, Employer’s Annual Federal Unemployment (FUTA) Tax Return. This is the form used to report federal unemployment tax, which employers’ must pay (i.e. out of your own pocket) on behalf of each employee. The tax is typically 0.8% of the first $7,000 in wages paid to each employee each year. So the most you pay for any one employee is $56, assuming the employee had at least $7,000 in wages.

The Form 940 is only filed annually. But the 940 tax must be paid at the end of any quarter in which the unemployment tax liability reaches $500. So you should be calculating the tax every quarter to see what your liability is. If it reaches $500, make a payment by the end of the month following the end of the quarter. If it’s less than $500, you carry over the liability to the next quarter.

Most small businesses that have fewer than 10 employees usually don’t have to make a federal unemployment tax payment for quarters 1, 2 or 3. But when the 4th quarter rolls around you will have to pay the entire annual tax liability. If your total annual tax is $500 or less, you can pay it with the Form 940 (be sure to include voucher Form 940-V). If the tax is more than $500, you must pay the tax at your local bank or via the IRS electronic payment system (EFTPS).

3. Form W-2, Wage and Tax Statement. You must give or mail W-2’s to all your employees no later than February 2, 2009. Employers must include Copy B, Copy C and Copy 2 along with the Instructions for Employee. In addition, you must send a copy of all W-2’s to the Social Security Administration by March 2, 2009, along with Form W-3, Transmittal of Wage and Tax Statements.

4. Form 1099-MISC, Miscellaneous Income. The most common use of this form is to report total annual payments to independent contractors (sole proprietors who provided services to your business) of $600 or more. You must send Copy B of the 1099-MISC to the recipient by February 2, 2009. And you must also send Copy A to the IRS by March 2, 2009, along with Form 1096.

Important: Your state probably has payroll tax forms and payments due on January 31 or February 2, so be sure to check with your state’s tax department for details.

The beauty of the internet has to do with the large amount of information made available on it. Simply put, you can download just about anything including legal forms. The question, of course, is whether you are getting what you pay for? With legal forms, you have to be extremely careful not to hurt yourself in the long run by saving a few bucks up front.

 

The thing that many people misunderstand about the law is jurisdiction. While most think of the law as one set of rules that apply across the nation, it simply does not work this way. Yes, there is a set of federal law that applies everywhere. Most issues you deal with on a daily basis, however, are controlled by state law, not federal. This is where a problem can develop with downloading legal forms off the web.

State laws are created by state governments. The politicians comprising those governments are elected by the people of the relevant state. The views of those people differ significantly from state to state. California, for instance is a far more liberal state than Alabama. As a result, the laws on a particular legal subject are very different in each state. With legal forms, this creates a huge problem.

Legal forms off the web may comply with the laws of your state regarding whatever issue they cover. Than again, the forms may not. There is no way to write a legal form that covers the variations from one state to another. When you use these forms, you run the risk of relying upon something that is not valid in your state! This is the path to a legal disaster.

Can you use free legal forms to handle a need? Sure. You should only do so, however, if the forms indicate they are specifically tailored to the laws of your state. If they do not, using them could end up being a mess.

Health: Health insurance policies cover the costs of medical treatments for various types of diseases that threaten human life. Disability insurance is considered as a different type of insurance that aims at providing financial support to the physically disabled individuals in society. Bond insurance: In this insurance service, the bond issuers can pay the premiums to a third party in case of failure on part of the issuer. In such cases, the third party provides the interest and capital repayments prescribed by the bond.

Business overhead expense disability insurance: The person who is insured by this type of insurance manages the risk of his/her disability by arranging the insurance authority to bear the business overhead expenses in case of the business entrepreneur’s disability. Chargeback insurance: This insurance is meant for the business merchants who accept credit cards. When accepting credit cards for purchases involving large money transactions, merchants risk their business. Fraudulent behavior on part of the credit cardholder or the use of unauthorized or invalid credit cards puts the merchant’s money at stake. Chargeback insurance policies protect the merchants from these risks.

Contents insurance: It covers the loss or damage to the personal possessions of an individual while they are located in one’s home. The insurance might also cover the possessions kept in the exterior of one’s household, such as things kept in one’s garden area. These insurance policies find utility for people renting houses. It is generally purchased in collaboration with a home insurance policy.

Corporate-owned life insurance: The employing companies hold this insurance for covering the sudden losses of their employees. Originally, these insurances were held by companies to cover the risk of the death of their key employees. This insurance insures the cost incurred on the recruitment and training arrangements that have to be made in case of an unexpected death of any of the company employees.

Credit insurance: Credit insurance policies are designed to compensate for credit risks in business.

Crime insurance: Employee thefts and offenses causing financial losses to a business are covered under crime insurance policies. Crime insurance can be used to cover the damage caused by crimes such as murders and rapes.

Critical illness insurance: Critical illness insurance policies prescribe a list of diseases to be grouped under the class of critical ones. The policyholders are insured in case of being afflicted by any of the diseases enlisted as critical in the policy. The policy may be structured to provide the insured individual with regular payments or a lump sum amount on being diagnosed for one of the critical illnesses.

Crop insurance: Agricultural producers purchase this insurance to protect themselves against a loss or damage to their crops on account of natural disasters or revenue losses.

Dental insurance: It is categorized under the class of health insurances and is meant to pay the costs incurred on dental care. Considering the increasingly expensive dental treatments, dental insurance policies form an important section of health insurances today.

Deposit insurance: These insurances protect the deposits in event of bank runs. A bank run is said to occur when a large number of customers of a bank withdraw their deposits from a bank. Deposit insurance aims at covering the risk of running into this kind of financial crisis.

Disability insurance: Disability insurance covers the insured individual’s earnings against the risk that a disability can make working impossible for him/her. Earthquake insurance: It is a type of property insurance, which covers the risks borne by houses on account of frequently occurring earthquakes. It insures the damage caused to property as a result of earthquakes. It is widely used in Japan and California.

Expatriate insurance: This insurance covers the losses that one may have to suffer from, while residing and working in a non-native country. An expatriate insurance policy has to be purchased before one relocates to another country. It covers the period of stay in the non-native country.

Fidelity bond: These bonds serve as a protection for businesses from the fraudulent behaviors of their employees.

Flood insurance: It covers the damages to property that result from floods. Around 20% of the households in the United States are insured for flood, as they are susceptible to them.

General insurance: General insurance schemes include policies for automobiles, homeowners and precisely any insurance that does not fall under life insurance. General insurance policies cover losses resulting from certain financial events.

Group Insurance: It covers the risks borne by a group of people. Group insurance policies are generally purchased for a group of members of a society or a group of professionals in an organization. It is less expensive than individual insurance policies.

Divorce, Taxes, and the IRS

In Divorce, potential tax liability can frequently become the tool for one spouse to use against the other spouse. If improperly used, this tool can destroy all of the marital assets. In the worst case, tax liability can seriously impact the future financial security of either spouse and subject them to criminal sanctions.

 

Situation 1 - Your Spouse Owns a Business

The most common situation where taxes become an issue in a divorce is they there is a family business. The owner - spouse may have hidden cash receipts or engage in a practice of recording inflated expenses. This common practice by many business owners is a fraudulent attempt to minimize taxes. The other spouse is often aware of and approves of this practice. During the marriage, minimization of taxes results in higher household income and a better lifestyle for the couple.

This practice is illegal or borders on illegal. During the marriage it is a secret between the married couple. But during a divorce each spouse may try to use past tax behavior to gain an advantage. The owner - spouse wants to minimize past income in an effort to lower child support, alimony, or division of marital property. Of course the other spouse wants to prove the opposite.

The result is a game of chicken - with one spouse threatening to turn the other spouse in to the IRS. This is a dangerous game for all involved. Do it yourselfers will find the situation blowing up in their face. People with attorneys may find the attorney reluctant to deal with the situation.

The Potential Problems:

Your Attorney cannot assist the owner/spouse commit the crime of tax evasion.

Situation 2 - You Make a Surprise Discovery: Your Spouse is a Tax Cheat

Another common situation in divorce: the sudden realization that a spouse is a tax cheat - and you were completely unaware until the divorce.

The Potential Problems:

You may end up owing the IRS half the overdue taxes.
You may end up owing the IRS the ENTIRE tax bill.
The overdue tax bill may be double the actual unpaid taxes, due to penalties, fines, and interest.

The Potential Solution:

The IRS has a provision called Innocent Spouse Relief. This provision gives complete or partial tax forgiveness to an innocent spouse. But be aware - the definition of "innocent" is technical, elusive, and difficult to understand.

The second form of relief is slightly easier to get. If you qualify, the IRS will separate out the tax liability of your income from your spouse’s hidden income. This type of relief may have the effect of wiping out extreme tax bills and penalties.

The Bottom Line: Always be aware of these types of tax situations. The financial effect can be far worse than the divorce. If you believe this type of problem is in your future, start preparing immediately. Do not sign a joint tax return for your upcoming tax filing. File married-filing-separately. The moment you suspect a potential tax liability, begin to separate your financial life from your spouse’s financial life and then promptly file for divorce.

Legal Real Estate Forms: The Quit Claim Deed

A Quit claim deed is a formal deed transfer from the registered owner to another person or entity. Simply put the person who has legal rights to the real estate title transfers these rights to someone or something other than himself.


This conveyance is frequently used between divorcing partners and family members. The conveyor, or person claiming the rights to the real estate, transfers all claims and rights to the receiver. The quit claim deed does not guarantee that the conveyor has the legal rights to the real estate, just conveys claims and interests.

To be legally binding, the quit claim deed must be in writing, signed by all parties and recorded so that creditors or future purchasers of the property have notice of the transfer. This is best done by having a legal quit claim deed written, signed and notarized then filed in your local county or parish courts. A legally binding quit claim deed is required in all 50 states with few variances. Local ordinances or an attorney can advise of the particular aspects of the deed that must be present in your state. A handshake and a gentlemen’s agreement will not provide the legal basis for a quit claim deed. The statue of frauds requirement makes oral or other type agreements unenforceable. In other words, "Get it in writing."

 

Since this type of deed transfer gives the receiver the rights to the real estate and the conveyor gives up the rights to the real estate, does this mean that the creditor has to honor this deed transfer? No, not necessarily. If you are simpl y saying your spouse no longer has interests in the property and there is no actual sale of the property, the creditor has the right to hold all original parties accountable to the loan. In other words, if you file this in the local courts and the person receiving the property does not pay the loan, the creditor can come to you for payment. Unless it is a sale, approved by the financial institution, the quit claim deed is just a transfer of rights but not a release of financial responsibility. To be financially free of the real estate, further documents are required.
